Terms of Service

By purchasing or downloading any product from this store, you agree to be bound by these Terms of Service. If you do not agree, do not complete your purchase. These terms constitute the entire agreement between you and CWShop regarding your purchase. We reserve the right to update these terms at any time. Continued use of purchased software constitutes acceptance of any revised terms.

When you purchase a CWShop product, you receive a single-installation, non-exclusive, non-transferable license to install and operate the software on one server or hosting account under your direct control. Your purchase includes: the application files as a downloadable ZIP or PDF, access to the version purchased at the time of sale, and the documentation included with the download. Your purchase does not include: the right to resell, redistribute, sublicense or share the software or its source code with any third party; hosting or managed installation services; guaranteed future updates; or any professional services.

Permitted uses: You may install the software on one server for your own personal or business use. You may make a single backup copy for disaster recovery purposes. Prohibited uses: You may not copy, resell, redistribute, sublicense, rent, lease or lend the software to any third party. You may not modify and redistribute the source code as your own product. You may not remove or obscure any copyright notices or branding. You may not use the software to build a competing product or service. Violation of these license terms will result in immediate revocation of your license without refund.

Each purchase of a CWShop system product includes one license key. This key is issued to the purchasing email address and is tied to a single installation. You are responsible for keeping your license key secure. Do not share it publicly. If your key is compromised, contact us immediately to rotate it. We reserve the right to revoke or suspend a license key if: (a) a chargeback or fraudulent payment is detected, (b) the license terms are violated, or (c) the purchase is reversed or refunded. Following revocation, the software will require reactivation with a valid key within 48 hours.

All products are delivered as digital downloads. Download links are valid for 48 hours from the time of purchase and are limited to 5 download attempts. If your link expires before you have successfully downloaded your file, contact us and we will issue a new one. Once a file has been downloaded, the transaction is considered fulfilled. It is your responsibility to store and back up your downloaded files.

Payments are processed through the following providers:

• PayPal — credit/debit cards and PayPal balance
• Volet — alternative payment methods via the Volet SCI gateway
• Wise Transfer — international bank transfer via Wise (manual confirmation required)

By completing a purchase you agree to the terms and conditions of the applicable payment processor. All prices are in USD unless otherwise stated. We reserve the right to refuse or cancel any order at our discretion. For Volet and Wise payments: once a payment is confirmed, the transaction is final subject to our Refund Policy.

Please review our full Refund Policy before purchasing. The key points are:

• Digital downloads are generally non-refundable once the file has been accessed.
• If you have a genuine technical issue that prevents you from using the software, contact us within 7 days of purchase and we will work to resolve it.
• We do not offer refunds based on change of mind after download.

All products are provided "as is" without warranty of any kind, express or implied. We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements. Because our software products are self-hosted on your own server, we are not responsible for: data loss caused by server failures, incorrect permissions, or hosting provider issues; security breaches resulting from your server configuration; or compatibility issues with your specific hosting environment. You are responsible for maintaining regular backups of your data.

To the maximum extent permitted by applicable law, CWShop shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or business, arising out of or relating to your use of the software, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from a purchase shall not exceed the amount you paid for that purchase.

All intellectual property rights in the software, including source code, design, documentation and associated materials, remain the exclusive property of CWShop. These terms grant you a limited license to use the software; they do not transfer any ownership rights.

We operate a voluntary referral programme allowing registered partners to earn commission on sales they introduce. By registering as a referral partner you agree to the following additional terms:

• Eligibility: Open to anyone who registers via the Referral Programme page. We reserve the right to approve, reject, or suspend any partner at our discretion.
• Commission: Partners earn the current published commission percentage on the net sale amount of each qualifying purchase made through their referral link. Commission rates are set by us and may change at any time with notice.
• Holding period: Commissions are held for a minimum number of days after the qualifying sale to allow for refunds. Commissions on refunded orders are cancelled and do not pay out.
• Minimum payout: Commissions are only paid out once a partner's approved balance reaches the published minimum threshold.
• Payout: Payouts are made to the payment method registered in the partner's account. We are not responsible for incorrect payout details provided by the partner. Partners are responsible for any taxes on commission income in their jurisdiction.
• Prohibited promotion: Partners may not promote using spam, misleading advertising, paid search ads targeting our brand name, coupon sites without prior approval, or any method that violates applicable laws.
• Termination: We may suspend or terminate a partner's account and forfeit any unpaid commissions if the partner violates these terms, engages in fraudulent activity, or refers themselves or associated parties.
• Self-referral: Partners may not use their own referral link to purchase products for themselves. Such orders will be voided and commissions forfeited.
• Cookie window: Referrals are tracked via a browser cookie with a 30-day window. A sale qualifies only if the referral cookie is active at the time of purchase.

When using this store or any purchased product, you agree not to:

• Submit false, fraudulent, or misleading information during checkout
• Attempt to circumvent payment processing or initiate fraudulent chargebacks
• Use automated tools to scrape, attack, or stress-test this store
• Attempt to gain unauthorised access to any part of the store or its data
• Violate any applicable law or regulation in connection with your purchase or use of the software

These terms are governed by the laws of Jamaica. Any disputes arising from these terms or your purchase shall be subject to the jurisdiction of the courts of Jamaica.
